This document outlines the terms and condition for participation in the open call for proposals for the “Future Visions for the Internet” project.
These terms and conditions apply to all proposals submitted to Nesta (“Nesta”, “we”, “us” or “our”) for our “Future Visions for the Internet” project (the “Project”) as part of the European Commission-funded Engineroom project. Please read these terms and conditions and our privacy policy before submitting a proposal/pitch to the Project.
By submitting a proposal, you agree to comply with these terms and conditions and confirm you have read and understood our privacy policy.
Nesta is the UK’s innovation foundation. We help people and organisations bring great ideas to life. We do this by providing investments and grants and mobilising research, networks and skills. We are an independent charity (registered with charity number 1144091) and our work is enabled by an endowment from the National Lottery.
This Project is led by Nesta’s explorations and research teams, and is supported by funding from the European Commission under grant agreement number 780643 (“EU Engineroom”).
The Nesta-led Engineroom project is helping to articulate a vision for the Next Generation Internet initiative, the European Commission’s ambitious new flagship programme seeking to build a more inclusive, resilient and democratic internet by 2025.
Applications are open to all individuals over the age of eighteen (18) years old or organisations. Please note that Nesta reserves the right to include contributions from individuals under the age of eighteen, but this will be by invitation only.
3.1 We will assess all eligible applications received by the deadline set out in the call for pitches. At our discretion we will select applicants which in our view comply with the criteria set out in the call for ideas. The shortlisted applicants will be invited to attend a meeting to further discuss their ideas, proposed output and financial support, and then enter a formal contract agreement with Nesta.
3.2 Our decision about eligibility, about selection of applicants for the Project, and about the amount of financial support to be provided (if any), shall be final. We may publish general feedback on applications to the Project, but will not provide detailed individual feedback or enter into correspondence with individual applicants.
3.3 Any financial support awarded by Nesta will be subject to satisfaction of all relevant legal and regulatory requirements and signature of appropriate legal documentation.
3.4 You (and any partners, where relevant) must bear any costs relating to the submission of your proposal, your ultimate output submitted and participation in the Project. You must take independent legal advice if you are concerned about these terms and conditions or your participation in the Project.
3.5 We reserve the right to refuse to accept any proposal or final Project entry; to suspend or withdraw the Project at any time; to vary the form and substance of the Project or extend the deadlines; to reduce or increase the number of applicants selected for final participation and/or to reject any proposal or withdraw a place on the Project if you are in breach of these terms and conditions, fail to participate fully in the Project or in the event of an actual or potential conflict of interest. If any selected applicant subsequently withdraws or is withdrawn from the Project, we may select a replacement applicant, but will not be obliged to do so.
3.6 We reserve the right to vary the Project or these terms and conditions at any time and at our sole discretion. Variations will take effect from the date they are posted on our website so you must check this page regularly to see the current version. If you provide us with a contact email address, we will aim to notify you of any changes.
3.7 If you are unable to complete the proposal or Project entry process due to a disability, please let us know so that we can consider whether reasonable adjustments can be made.
By submitting a proposal and/ or entry for the Project, you confirm on behalf of yourself (and your partners, if applicable) that:
4.1 All information and materials provided to Nesta by you are true, accurate and complete and you will notify us immediately of any changes to information or materials provided. You are the author of the proposal and any subsequent entry submitted, and have not copied or plagiarised the work of another third party.
4.2 You have provided us with all information which might reasonably be thought to be relevant or necessary for us to consider your proposal and final Project entry.
4.3 You have, or will obtain as required, all authorisations, registrations, licences, consents and permissions necessary to submit your proposal and ultimate Project entry.
4.4 In participating in the Project, you will act lawfully, ethically and in good faith and will comply fully with equality and anti-bribery legislation and with any other applicable laws, regulations, guidelines and codes of practice, and will comply with our reasonable requirements, including in relation to health and safety and security, while attending interviews and meetings as part of the Project.
4.5 You shall treat the contents of any Nesta documentation and information shared with you as confidential, and shall not disclose such information other than as may be necessary for the preparation and submission of a compliant proposal and/or Project entry, and shall at Nesta’s request destroy or return any documents or information to Nesta.
4.6 Neither you nor any of your partners has any actual or potential conflict of interest with Nesta (including with our trustees, officers or employees) in making your proposal or complying with these terms and conditions and you will immediately inform us if you become aware of any such conflict of interest
5.1 Nesta shall acknowledge you, or your organisation, as the author/artist in any publication or report which include, in whole or part, any Project entries submitted.
5.2 Nesta reserves the right not to publish Project entries, and makes no guarantee that work or extracts therefrom will be published.
5.3 You agree that your final output will be published under a Creative Commons Attribution Noncommercial ShareAlike licence (CC-BY-NC-SA), full details here.
6.1 If your proposal is accepted, you will be required to enter into a contract on Nesta’s standard terms and conditions (copy available on request), which shall include the agreement to publish the final output under the Creative Commons licence referred to in paragraph 5.3 above.
6.2 Any failure by Nesta fails to enforce these terms and conditions shall not be construed nor shall it be deemed to be a waiver of its right to do so in the future.
6.3 We will not be liable to you, your partners or anyone else in respect of any direct or indirect loss, economic loss or loss of opportunity arising in connection with your proposal or application to, and your participation in, the Project and/or any reliance by you on any statement made or advice given by us, our partners or contractors. We do not make any warranty about the accuracy or completeness of the information provided by Nesta in connection with the Project. Any dispute between you and/or your partners and/or any other applicant must be resolved between you and independently of Nesta.
6.4 These terms and conditions shall be governed by and interpreted in accordance with the laws of England and Wales and shall be subject to the non- exclusive jurisdiction of the English courts.
